Robert Stephen Farley was a seventeen-year-old senior at Roswell High School in Roswell, New Mexico. He was born in Roswell and grew up there, but had moved with his mother, Marilyn Kendrick, to Rio Rancho, where he attended Cibola High School. In the autumn of 1991 he returned to Roswell for his senior year so that he could graduate with the friends he had grown up with. He was an honour student in all honours classes, described as the most college-ready pupil in the school, and planned to take preliminary courses at Eastern New Mexico University in Roswell before applying to law school, with Harvard or Yale in his sights. He was staying with his best friend, Danny Coleman, and Danny's mother, Debbie Coleman. His girlfriend was sixteen-year-old Tracy Jarvis, a devout churchgoer whom he had been dating for about sixteen months. Both families treated the pair as part of the family, and there were rumours that they were engaged.
Tracy invited him to her church, saying she felt sorry for him and wanted to help him. Tracy told him she was engaged to Farley.
Farley was brought to the office and said he had not been at the mall. He then frisked Farley, handcuffed him and put him in the back of a faded blue station wagon.
Debbie Coleman went to the Roswell police station and asked for Detective Fuller. Nobody there had heard of him. At a petrol station they soaked a cloth in starter fluid, which was mostly ether, and held it over Farley's nose and mouth until he passed out; the attendant was told to stay away from the car. At 12.40 p.m. a witness saw the light blue station wagon parked behind the abandoned Cedar Lake Lounge, thirty miles east of Artesia on New Mexico Highway 529 between Hobbs and Artesia.
At 2.22 p.m. Farley's mother received a call demanding $50,000 for her son's return and threatening to kill him. He drove to the station in the station wagon. A search of the car found Farley's palm print on the roof and a shoe print against the window, and police seized a police scanner and a pair of pliers. At the Cedar Lake Lounge, in a small walk-in cooler at the back of the tin building, they found Farley stuffed inside. Insulated wire was wrapped around his neck and he had been stabbed eleven times with an ice pick. His face had been beaten. The pathologist said both the strangulation and the stabbing occurred while he was alive and either could have killed him.
He was brought back to Roswell and gave a second statement. He admitted kidnapping but said he would not go down for murder.
The school district said its policies had been followed. It said the man posing as an officer had displayed a two-way radio and handcuffs and recited the Miranda warning, and that although no identification was requested, a badge would have been produced had it been. The family's lawyer said the statement gave them grounds for a lawsuit. The board later proposed requiring officers to show a badge and photo identification and to have their credentials verified with a superior. Farley's family asked for a scholarship fund in his name.
At hearings on 10 February and 3 April the defence said it would seek an extension because of scheduling conflicts, and the district attorney assumed the paperwork had been filed. An assistant district attorney resigned the next day.
In 1993 Marilyn and Luther Farley filed a wrongful death suit against both men on behalf of their son's estate.
