The story

She walked past Donna's office with her hand on the gun and could not do it.

He had also recruited Donna's neighbours. One plan was to hide behind a large rock on the road to her cabin with a shotgun while one of the women ran her off the road.

Donna had moved to Idaho in 1999 and was building a cabin in a wooded rural area outside Kendrick, in Latah County. That spring she began a relationship with Fred Palahniuk, 59, a retired railroad brakeman and Navy veteran, the father of the author Chuck Palahniuk. On 28 May 1999 Fred and Donna visited her brother Gary Fontaine at the house Gary and Donna's daughter owned, where Donna was building an extension.

He left around dark and, on his way home, saw Donna's pickup in the driveway and smelt smoke. He called the es to say the garage was on fire and that they needed the fire service. At 7:40 p.m. Deputy Richard Skyles of the Latah County Sheriff's patrol found the two-storey garage completely engulfed and was told there might be a suicide victim inside; a detective was sent for. The garage was destroyed. Hours later two badly burnt bodies were found in the rubble and identified as Donna and Fred.

A state fire investigator concluded the fire was arson. Dr Robert Seahack's autopsies found shotgun pellets in Donna's right chest, a .32-calibre bullet in the back of her neck and a .32-calibre wound in Fred's chest; the doctor said the bullet wounds were fatal and both were dead before the fire.

The theory was that he ambushed the couple, shot Donna in the back of the head, shot Fred in the chest as he turned and then used the shotgun on Donna again.

In 2011 the US Supreme Court declined to hear his case. Fred is buried in Benton County, Washington; Donna's grave could not be found.
