The story

On 15 January 2010 De Himes and her boyfriend Dennis David walked into the Sheridan police department in Wyoming and told officers there was a dead body under the trailer they shared. Himes did the talking. She did not believe him until she went into the spare room and found Bloom lying dead on the floor. She and David went back to bed. Fearing they would be next, Himes and David went to the station.

He had three beers in the car on the way home from work at eight o'clock, a pint of vodka and another beer and a half at his girlfriend's house, then five to eight rounds of beer and shots at a first bar and more at a second, where he also bought another pint of vodka. He had taken Adderall as well. A friend, David Whittaker Fossett, was with him for the later part of the night.

He told Fossett to come and watch, saying he was going to kill Bloom. Fossett followed him down the hallway. He then checked Bloom's pulse, found that he was still alive, fetched a knife, cut his throat twice and stabbed him in the neck four to six times. The forensic pathologist found that the chokehold had broken Bloom's trachea and that at least four of the stab wounds had been delivered with significant force.

He put the body in a sleeping bag, dragged it out of the trailer, pulled aside boards and pushed it into the crawl space. He then went back inside and fell asleep on the couch. Later that morning he went to breakfast with Fossett and three other friends, still covered in blood, and drank more vodka and beer before and after the meal.

A knife with blood around it was in the sink, there were bloodstains on the bedroom carpet, and Bloom's body was in a sleeping bag under the trailer. He said Bloom owed him $20, that they had fought and it had gone a little too far, that what the other witnesses had said was probably what happened, and that he supposed he needed a lawyer to find out whether he was facing life or ten years. He then asked for an attorney and the interview ended.

The hospital concluded that he was fit and that he had not lacked that capacity.

At the preliminary hearing the court found enough evidence to proceed. His public defender's strategy was to argue that he had been too drunk to form the intent required for first-degree murder, and the defence called witnesses to his drinking and drug use that night and to his history of heavy drinking and blackouts. Fossett was the prosecution's central witness and described the killing, the washing, the sleeping bag and the crawl space.

His new lawyer argued that the original lawyer had done too little to put the intoxication defence. One justice wrote separately, agreeing with the result but arguing that the standard requiring a defendant to prove that the outcome would have been different makes it practically impossible to show prejudice. Himes and David were left paying the whole rent.
