Loche was bleeding from the ear and said Max 'Sunny' Cordova, twenty-five, had beaten him. The three drove around looking for Cordova and shortly after midnight blocked in a white pickup in which Cordova sat with nineteen-year-old Julian Cole. Bingham saw a gun and got back into the car. Cordova died quickly.
Loche had been subpoenaed to testify on 12 April 1977.
Cummer ran inside and told Michael O'Neill to stay there because 'something's coming down'. He heard two shots, Loche shouting, 'Don't, Paul, don't,' then two more and, after a pause, another. Cummer and O'Neill dug a grave behind a sage brush and buried the body.
A tip in May 1977 led police to a three-foot grave in a hay stack yard on the Oliver Sager Ranch, four miles east of Fruitland and four miles south of U.S. 40. The body was identified by dental records.
Police sealed American Fork Canyon and Provo Canyon; near Mount Timpanogos campground, about two miles north of Sundance, the escapees fired on a camp host, who fired six shots back. In a note to his mother he wrote that he would rather be dead than spend the rest of his life there.
