Francis Kelly was 46 years old in 2019. Born in Cleveland, Ohio, he went to St Ignatius High School and Ohio State University and took a master's degree at Butler University in 2007. A hearing was set for 27 January 2021.
They refused.
He ate it, became ill and recovered, putting it down to the soup going cold.
On 27 October 2020 a man telephoned the Clark County Sheriff's Office in Ohio at 9.42 p.m. to say that a crime which could take a life was going to happen in Zionsville, Indiana. He promised to call back with her address and never did. The calls went to the wrong counties; the Carmel police in Hamilton County, where Kelly lived, were never told, and the administrative lines did not record caller ID.
On 15 January he sent his last texts, about custody, and was not heard from again.
That evening the two women drove to the house. He was breathing abnormally and gasping.
Kelly's ex, Courtney Nugent, the mother of his nine-year-old daughter, raised the alarm when he failed to collect the girl on her birthday. The Carmel police carried out a welfare check, knocked, got no answer and left. Nugent broke in on 18 January and found him dead on the couch; he had been dead for three days. The autopsy found blunt force trauma to the eye and head and gave the cause of death as asphyxia from strangulation and neck compression, with acute fentanyl intoxication a contributing factor.
The judge barred her from contact with Kelly's two children, including her own daughter.
