The story

Blackfoot, Idaho, is the seat of Bingham County in the south-east of the state, a potato town of about 12,000 people. The murder at the centre of this case happened a few miles south-west of it, in Pingree, a settlement of roughly 1,200 people.

On the night of 9 February 2017 David Lee Davis, a thirty-year-old father of three, went to the Fort Hall casino with his friend Marie Baker. Davis had met Baker a few weeks earlier after he recovered some stolen property for her, and the two of them used methamphetamine together. Baker did not know where Pingree was and did not want to go, so she lent Davis her white Pontiac Grand Prix. She lived in a double-wide trailer in Pingree with her seventy-three-year-old mother, Betty Duke.

Inside the trailer Betty Duke heard two shots.

She told Lopez it was like putting a dog out of its misery.

On 10 February she called Lopez for help and picked him up with her three dogs. On the drive she told him she had killed Davis. At the trailer Lopez saw the body lying on plastic in the kitchen, blood and what he called human debris on the walls, and part of a skull with 'bones and stuff' in the wood-burning stove. Lopez went with her to a friend in Blackfoot for kerosene, but then told her he could not help, went home, spoke to his daughter and walked into the Bingham County Sheriff's Department at about nine that night.

He described the trailer, the four vehicles outside, the guns, the meth lab and the bones in the stove, and drew a diagram. Deputies found the trailer on Google Maps from Lopez's description and went out at about eleven that night. There were five cars in the driveway. When officers said they needed to check on a person who might need medical attention, she refused them entry and demanded a warrant. Betty said she wanted a coat, so officers escorted her inside and swept the home. In the laundry room they found a black plastic bag containing two feet; in the kitchen they saw a body wrapped in black plastic.

A search warrant arrived at three in the morning, six hours after Lopez had walked in. The search found the feet, the body, a skull and bone fragments filling the wood stove. The autopsy showed two small-calibre .22 wounds to the thighs, just above the knees, which were not fatal and had been bandaged with tobacco packed into them. Methamphetamine and hydrocodone were in his blood.

She moved to suppress the evidence, arguing that the entry violated the fourth, fifth and sixth amendments, but the court refused: there was an exigency, a protective sweep was justified given the guns, the meth and the extra car, and the evidence would inevitably have been discovered under the warrant anyway.
