“A cute little town that looks like a perfect tourist area, exactly old West and kept that way, with a fantastic candy store; some areas look nice to live in but most of the town could use an update and looks a little run down.”

The story

Bill Stout was born in San Jose, California, on February 28th, 1955, and went to high school in Arkansas before ending up in Montana. She already had a son, Ben, when she and Bill married in Montana in 1986, and Bill adopted the boy as his own. They had two more sons, Noah and Matthew, and settled on a twenty acre ranch at Trapper Meadow Road in Darby, where Bill worked as a third generation sheet rocker. For roughly the first fifteen years the marriage was uneventful.

Over the winter break of 2000 Ben, a nineteen year old college freshman, took his own life. In 2004 Bill took out a $500,000 life insurance policy on himself, with the usual exclusion preventing payment for suicide in the first two years, which began in January 2005.

Early in 2005 Bill travelled to Arkansas alone for the wedding of a high school friend. The night before the wedding, at the hotel bar where the wedding party was staying, he ran into Barbara Miller, his high school sweetheart, who was the bride's sister. They talked for hours, moved to his room when the bar closed, and spent the night together. They attended the wedding as a couple. He called her twice after he got home and bought her a plane ticket for Memorial Day weekend.

Bill admitted the affair, emailed Barbara to say it was over, cancelled the ticket and promised never to contact her again. Barbara was furious at being dumped a second time and said she would fly to Montana and camp on his doorstep until he spoke to her face to face. Over the following month she cooled off and never came.

On June 1st, 2005, an email arrived at the house from an address reading freakofark, saying: I love you, we're gonna be together, we're gonna meet face to face. Bill deleted it. Bill went to the Ravalli County sheriff and reported harassment. After that the campaign moved beyond paper: his truck was egged and smeared with faeces, potted plants on the porch were broken, the family received hang up calls from pay phones, and a credit card and financial papers went missing from the house. Bill told the deputies he was frightened that Barbara was in town and had been inside his home.

In May 2007 Bill put the ranch up for sale, which caused a serious fight, and afterwards the couple seemed to be getting along better.

On June 1st, 2007, Bill reported that a nine millimetre Beretta, its holster and ammunition had been stolen from the house. He told the sheriff he believed Barbara had taken the gun, though he admitted he had not seen her do it. He spoke to a friend shortly before ten o'clock about a horseback ride pled for the next morning, and the couple went to bed. Their son Matthew was out and came home before midnight. Sometime between ten and midnight Bill was shot once in the back of the head as he lay in bed. The body was moved afterwards.

She then took Matthew to Missoula for a day of shopping. Deputies found a nine millimetre cartridge under the pillow and a single gunshot wound to the back of the head. A search of the house produced the missing pistol in the saddlebag of Bill's motorcycle in the garage, the holster in a laundry hamper under wet washing that smelt strongly of bleach, and the ammunition on top of the gun safe with three rounds missing. A note in her nightstand, in her handwriting, gave instructions on firing a pistol; she said it was really instructions for Noah on using the washing machine. A botanist showed that a blossom found in the ammunition box came from a bush that had not bloomed until at least six days after Bill reported the gun missing, so the box had been hidden outside. Her DNA was on the envelopes, and handwriting on one invitation was identified as hers. A convenience store video placed Barbara Miller in Arkansas on the morning of the killing, and there was no evidence she had ever been to Montana. The autopsy showed undigested food, putting the time of death before eight in the morning, and the medical examiner concluded he had been dead eight to twelve hours or more when examined, with lividity and blood patterns showing the body had been rolled over after the shooting. There was no gunshot residue on his hands and no fingerprints on the gun.

The prosecution case was that she had spent two years manufacturing a stalking campaign against her own family. Matthew testified that he had heard nothing unusual that night, not even a gunshot, and that his father was hopeless with computers.

She was also ordered to pay defence costs.
