Machiasport is a small town on the coast of Washington County, Maine, close to the Canadian border. He joined the US Navy on September 10, 1964, four days before his eighteenth birthday, hoping to train as a diver on a route that could have led to the SEALs. On May 2, 1965 he was riding a motorcycle when, depending on the account, he lost control or was forced off the road by a car. He suffered a concussion and a broken arm and was semi-conscious for six weeks. At the Chelsea Naval Hospital near Boston an aneurysm was found on an artery in his neck, present since birth. It burst on August 16, 1965 during surgery to implant a valve, causing a stroke, and he was given a full medical discharge on December 17, 1965. He was thereafter described, and described himself, as a disabled veteran, though the disability came from the motorcycle accident and the aneurysm rather than from combat.
Cord said the only crime Cutler had seen in years was someone stealing branches from a balsam tree for Christmas wreaths.
In 1979 the family moved to Machiasport, to a house on Route 192 near the ocean. The cause was never established. They collected the insurance and rebuilt, adding pillars and a large picture window, secret rooms, hidden passageways and tunnels leading from the basement to a shooting range in the yard with man-shaped targets. It had several security systems, air raid sirens, loudspeakers, aircraft landing lights on the corners, tripwires in the lawn, German shepherds under the front porch and, at one point, thirty-eight firearms, many of them loaded, including guns kept in the bathrooms. He kept food, ammunition and weapons caches in the house and in the woods, taught his sons to use M1 carbines before they were ten, and ran daily military drills with Anita and the boys. The drills were called Marty raids, after Anita's ex-husband Marty, whom the family had not seen since about 1975. One person called it an unreasonable fear of Marty.
The Phillips family moved from Indiana to Maine in 1985. Michael Phillips was thirty-eight and worked as a surveyor; Florence was forty-one, had five children from a previous marriage, and had to stop working because of a heart problem. Their son Michael was ten. They bought a house diagonally across the road from the s, and the families were initially friendly.
The friendship ended after the Phillipses held a family reunion on their front lawn. The Phillipses denied it, and the police told him there was no proof and nothing to investigate. He bagged them as evidence and called the police repeatedly. Over six months, from roughly February to August 1989, he filed forty-seven complaints against the Phillipses with the state police. He used a megaphone to shout insults at them until they went inside, trained aircraft landing lights on their house, and began firing guns in his front yard with his sons. The police said target practice on private property was legal in rural Maine. Michael Phillips, a quiet, hard-working man, obtained a concealed weapons permit on June 27, 1988, and the Phillipses set up a video camera in their front window to record the harassment.
Kilton said he had been firing blanks on the beach behind the Phillips house. A state police lieutenant, Thomas Michoud, said the complaints were escalating towards an explosive point.
On the evening of August 29, 1989, the Kiltons were visiting the Phillips house. They walked north along the road and turned back. Then came a large number of shots. He came back a second time with Ricky and Jerry, both armed with .30-calibre rifles, and the three of them fired twenty to twenty-five rounds into the couple on the ground. The boys later said they fired when their father fired.
Inside the Phillips house, Colby and Vanessa Kilton and young Michael lay on the floor while the shooting went on; the Kiltons covered the boy with their bodies. When troopers arrived they found the Kiltons crouched behind a pickup truck, shaking, with Michael. The officer wrestled it away. He told police captain John Wynott that Phillips had come to the house with a gun and challenged him.
A search of Five Posts Estate found antique guns, submachine guns, assault rifles, shotguns, pistols and large quantities of ammunition, along with books on combat techniques. The bomb squad found no bombs but did find extensive security systems and numerous homemade electronic devices. Child services took the boys from Anita and placed them in foster homes.
Sandra Miller testified about the boy's nightmares and a suicide attempt. Jerry and Ricky testified that they had done what their father wanted, and under cross-examination admitted receiving secret notes from him in foster care outlining what to say. Anita said they had always feared the Phillipses.
He said he put on his flak jacket, grabbed a shotgun and fired twice because he believed Michael Phillips had fired first, and that he did not remember the other shots. At the insanity hearing the defence called Dr Brian Rhines, a psychologist, who said brain damage from the motorcycle accident had aggravated existing psychological problems and produced an intense delusion of persecution.
In 1992 Sandra Miller and Michael Phillips Jr filed a wrongful death suit.
